you mean the GoP failed because of their pushback on gun laws. He was asked to surrender his gun when he applied for a carry license. But because of the NRA and GoP the police have no system in place for how to forcibly remove a gun from someone that isn't allowed to have one. He also passed the background check because the GoP refuses to allow the system to be reformed to be more comprehensive and allow the different agency databases all to be linked with NICS. He was known to be dangerous and armed and law enforcement couldn't legally do anything about it except ask nicely.
The dems should pull a Trump and have the families of those dead people appear at every news conference pushing for new gun control laws.
