I don't see that as a valid excuse. He can afford good representation for that charge as it wasn't anything serious at all. Maybe not the absolute best representation but plenty good enough.
First of all, why the videos of the 3 officers are shown in the order they are is beyond me, the third video (Officer 3) is where you will find initial encounter with the suspect.
Second, IF the fleeing but armed suspect even raised his gun in the general direction of the officer who had his gun trained on him and had ordered him to freeze and drop his weapon (which is what appears happened), the shooting is justified. Questioning whether the amount of force used was appropriate is a tangential argument rather than a central point (though one that should certainly be of concern to those within the police department, since crossfire and the risk of bullets straying from their trajectory when shot through a windshield posed a real risk to the responding officers in this instance).
