Billion's UK games website is gone thanks for the copyright nazis :(

Those of you that remember. Back in the day I had a ton of UK basketball games and older football games hosted on megaupload.... I lost a lot of past UK games most of them i think happened right around Cal's 2nd season.
I was a Video Admin on Wildcats Thunder were a lot of those videos were. After mega got shut down. I tried every way possible to keep it going, even where there were a lot of personal problems going on in my personal life I tried to find ways to keep things going. I actually had to step away from WT because at the time things going on in my personal life was too much to maintain what i was doing before.. so I basically retired. Could of handled it differently but when you have a loved one dying of pancreatic cancer youre in a IDGAF mode about everything else but your loved one.

Before that most of you knew me when I streamed on Justin TV. Had the Funchester channel on there.... I know there were at times It hit about 10K viewers at once for a couple of games when we played in that tourney in Mexico?.... anyways I got banned on Justin TV so much I got the dreaded IP Ban there so they killed a great thing I had going there. The thing that pissed me off the most about that was, the selective targetting of streamers they took action at. Others whod stream similar material, or they'd stream copyright material (EX. movies that were still in theaters, TV shows etc..) They were allowed to continue to stream on. I got Banned forever for streaming there. I never asked for a dime off anyone. I streamed for you guys who love Kentucky Basketballl. I know Billionth did the same thing. His site was for the fans and never would ask for a dime if he didn't have to keep up the costs for hosting.

I'm not going to promise anything at this point because like Billionth we both don't need any legal issues when it comes to this stuff. I know Billionth feels the same way and as bad as I hate to say it . UKBASKETBALL LIVE will never be back, just like the Vault on WT and for obvious reasons Funchester on Justin TV will never come back. The site I use now to try and let the legacy live on as of right now is still going for now, however as early as last year I considered retiring for good just because I don't have a true secure place to stream during the season. The amount of viewers I get per game, I would have to charge people and thats the last thing I want to do. If I had enough cash I'd buy my own server, which some of them to do what Billionths site could do is like up to $4,000 +. Being on a fixed income myself no way I can afford to maintain the costs and again the legal shit that would come with it, just took risky.

All I will say at this point is if things get too difficult for me, I will be retiring from streaming as hard as that is for me to say to all the people who I love and cherish doing this for you guys over the last decade. However if worse comes to worse and I do have to retire from stream. I will make sure you guys have a way to watch and I will work with you on setting things up, where you dont have to depend on sites where you can pick up viruses that will cause you more problems.

God Wildcats Thunder brings back memories. Use to download the games off there and burn them for my uncle who was ill and couldn't catch them live often. Always appreciated the effort brother. Hope all is well

One question,I see a lot of video's on youtube that seem to avoid copyright infringement claiming "the fair use act", would that option apply to your site? It would of course have to be non profit .
 
I guess I can maybe understand not being allowed to post the current season's games but there is no good reason why they should've made UKBillions take down the history games as well.
If a corporation is going to strictly enforce its copyrights then it should make an effort to make the content available to consumers.
I understand how annoying this is. Nothing better than watching an old game......But intellectual property - like a copyright interest - is just that, property. It's no different in that sense than the house or truck you own. And, pretty obviously, if the property is yours, you should get to decide how and when it's used. I don't know who exactly owns the copyright to these old broadcasts, it's probably several different parties (UK, the other team, the SEC, the NCAA, CBS, whomever) - but they get to decide what to do with them. You saying, "well it makes sense for them to do this, but not that"......Imagine if someone took the same approach with your house. "I can understand you using your house right now, but in a few months there are several homeless folks who surely could use your house, and there is no good reason why they should have to sleep outside while you are safe and warm.".....

Don't get me wrong; I don't have a dog in this fight.

I have over 1,300 UK games on DVD and tapes. I don't sell them; however, I have given a bunch away and they end up at places I never dreamed that I would see.

I wish that there was a place to see all the old games. But we do have laws to protect property. The rights to those games belongs to the folks who paid for the right to cover the games and then paid and sent the crews to do the games.

Back in the late 1970's when video tape first came out, recording UK basketball games was a very expensive deal. In 1977 I bought an RCA video tape recorder for $1,300. A two-hour video tape was $25.00. In 1978 they came out with the four-hour tape and it did cut the cost in half. It was before cable in my area (Jacksonville, FL at that time) so I had to get a new, higher off-air antenna. Some of the games were on UHF channels and it was nearly impossible to get the ghost out of the picture. So, it was a lot of work trying to tune the antenna to get a decent picture to record. So, to record a game required effort and money. Now it is easy and cheap.


A few years back I recorded an ESPN Classic of a game I had recorded back in the 1970’s hoping that it would be a better picture. It was as bad as mine. I think that it was my recording as it was the same TV logo down in the right side. It had the same ghost patterns. Probably wasn't but they do use people’s personal archives to add to their collection. I often wonder how they got those games. It may have been from sites like BlueWorldOrder or BillionthFan. I assume their agreements with NBC, CBS et.al. allows them to re-broadcast them. But some of them are home made.

I now use a computer to record the games and burn them on a bluray DVD. It is less than a $1.00 a game. Plus, the picture is perfect.

That analogy is totally invalid and is not the same at all. You're talking about property in the physical sense. Of course if that gets stolen then the owner is without it unjustly and to the owner it's gone, possibly forever if the owner cannot recover it. What we're talking about, archiving/preserving games/history is nothing like that at all.

The archiving/preserving old games OTOH is not "stealing" anything at all, all that is being done is to preserve/archive history, no different than the way a library does it. And without this, these vintage games might be forever lost.

We all get that Bert, but Movies are available for public consumption to buy...are these games?! They’re just sitting there. Plus, these folks aren’t even making money from it

Actually it is not different, so I don’t think you get the copyright stuff. Entities paid for the broadcast rights. They really have no choice but to defend them. The fact that there is or isn’t profit involved is rather irrelevant.

Copyright laws and others like them is what we enjoy as an evolved nation of laws. It's what separates us from 3rd world countries and even Russia and China. Small price to pay IMO.

I do get it. I work in the field. We get they pay rights, blah blah. What good is anything if it’s sittjng in a vault where no one can see. Great protecting those intellectual rights!!

In fact, I have a copyright and a trade mark. My lawyer advised me that they are worthless unless I am willing to sue.

My lawyer, who specializes in intellectual properties, charges $500 an hour to tell folks that second sentence; however, he will not set an appointment with you for less than an hour! That price was way back in 1987, so the price may now be $1,000 an hour.

So, if you have intellectual property you must be willing to go to court. Otherwise it is useless. Folks who give the NCAA, conferences and schools millions of dollars for rights to the games and then spend a bunch of money on televising them should have an incentive to protect their property.

edit: no one seems interested in stealing my intellectual property. That sort of pisses me off! :angry:

Legally, of course, you are right. I am not so sure from a moral/ethical perspective. If I have an unused chair and a refugee family moves in next door with nothing, they will get the chair. In my frame of reference, I really own nothing. Life and everything in it is a gift.

I just think the world would be a better place if "they" quit protecting their possessions and instead shared them. If Billionth were making money off this, I could see shutting it down. But, when someone is just offering something for free that isn't available any other way, I just fail to see the harm of allowing it to continue.

What does the NCAA have to do with this doofy? The SEC Network owns UK's media rights and pays millions for it. They're gonna protect their investment. Besides, who are you to say how much money anyone should make? Do you understand capitalism and how a free market works? If you want to start controlling what is enough money for someone to make, move to a communist country.

Fundamentally I agree from a common benefit perspective. One would like to see a mechanism to ‘donate’ such rights. Unfortunately there are some nasty precedents in this area. For example if they just chose to ignore their IP in this case, in the eyes of the law, one might rightfully assume they simply don’t care about any of their rights. It’s sort of like arbitrary ignoring one clause in a contract. It can place the entire agreement in jeopardy.

Bert raises this same issue. Unfortunately, I’ve encountered it in my professional life as I’ve chosen to give away research that could have been monetized but really belonged in the standards arena. This resulted in a pissing contest between lawyers who insisted I was essentially giving away much more. Best of intentions almost got me in a lot of trouble.

Bottom line, under the current legal system, there was really no choice except to defend their IP rights. Damn shame, but it is what it is..

If I had enough cash I'd buy my own server, which some of them to do what Billionths site could do is like up to $4,000 +. Being on a fixed income myself no way I can afford to maintain the costs and again the legal shit that would come with it, just took risky.

All I will say at this point is if things get too difficult for me, I will be retiring from streaming as hard as that is for me to say to all the people who I love and cherish doing this for you guys over the last decade. However if worse comes to worse and I do have to retire from stream. I will make sure you guys have a way to watch and I will work with you on setting things up, where you dont have to depend on sites where you can pick up viruses that will cause you more problems.

There was a site called stage6 that I used to see UK games. For some reason, I want to associate you to that site.
Anyway, I LOVED what the streaming guys did for UK fans here on Rafters.

My guess is the reason they shut down sites like this is because it’d be pretty easy to hide live game coverage amidst a database of archived games. I don’t see archived games holding that much value to networks. And I also guess the reason they don’t invest in a subscription streaming service for archived footage themselves is because it wouldn’t make money.

What does the NCAA have to do with this doofy? The SEC Network owns UK's media rights and pays millions for it. They're gonna protect their investment. Besides, who are you to say how much money anyone should make? Do you understand capitalism and how a free market works? If you want to start controlling what is enough money for someone to make, move to a communist country.

In fact, I have a copyright and a trade mark. My lawyer advised me that they are worthless unless I am willing to sue.

My lawyer, who specializes in intellectual properties, charges $500 an hour to tell folks that second sentence; however, he will not set an appointment with you for less than an hour! That price was way back in 1987, so the price may now be $1,000 an hour.

So, if you have intellectual property you must be willing to go to court. Otherwise it is useless. Folks who give the NCAA, conferences and schools millions of dollars for rights to the games and then spend a bunch of money on televising them should have an incentive to protect their property.

edit: no one seems interested in stealing my intellectual property. That sort of pisses me off! :angry:

This is absolutely accurate as I understand the law. Problem is that you can’t selectively defend those rights. Allow one copyright to be compromised and you risk your other protected IP as well.

That said, you can chose to forfeit a given set of IP. However, you must be willing to engage your attorney to do this such that your other iP is not similarly compromised. In other words, you incur substantial costs to make something free.

Few of us would be willing to do that.

Legally, of course, you are right. I am not so sure from a moral/ethical perspective. If I have an unused chair and a refugee family moves in next door with nothing, they will get the chair. In my frame of reference, I really own nothing. Life and everything in it is a gift.

I just think the world would be a better place if "they" quit protecting their possessions and instead shared them. If Billionth were making money off this, I could see shutting it down. But, when someone is just offering something for free that isn't available any other way, I just fail to see the harm of allowing it to continue.
So it’s moral and ethical to take something that belongs to someone else and redistribute it to the masses?

If you walk out in public, anyone can take your picture: public consumption. They can use it in public broadcasting, news or whatever, with no compensation to you because you were in public. (Minor aged excluded). They can even archive it and use it against you, in a court of law.
When networks broadcast a game, they submit to public consumption. These days that means digital reproductions because the property is in the public.

Don’t believe this, start showing Harry Potter to the masses for free. JK Rowling will quickly crawl up your ass with a vast army of attorneys. This in spite of the series having aired on network TV.

You can copy the broadcast and watch it till your eyes swell shut. But you best not try to profit from the reproduction. That is the difference.

Enjoy the copy protected content all you want................. just don't try to sell or distribute it.

It is legal if the owners of the copyrighted material "give" the permissions for the material to be used in a particular way, which they can and often do. Having said that, I do realize there are serious issues involved and the discussion isn't all that simple.

Again, life is a gift. I believe that sharing is a moral obligation. Having said that, I do realize that UK basketball games aren't in the same category as feeding the hungry or providing a bed for the homeless, etc[winking]
