A 1948 case set during WWII is a lot different than the current situationwhere there is no declared war. Whether the judge was right or wrong will be determined by a higher court, as if should be. Truman continued to invoke the law after WWII the same way it was used during the war. The fact that there is no real war now and has not been a war presents the legal issue. It is not a question of constitutionality of the law. It is a question of whether if the law permitted Trump to do what he did. It’s a bona fide legal issue. And whether the courts should defer to Trump on this issue is certainly a part of it.
