Privilege doesn't exist if they committed a crime, that's lawyer 101. And the FBI can look through his currently privileged communications with a privilege team. Those agents have to swear to not reveal any information in the case that it stays priveleged and can't be currently working the case. To get a warrant to seize privileged conversations the judge had to agree that a crime was being comitted. The DOJ also has to personally review any case where privelege is being broken, by either the AG or deputy AG. Cohen is screwed.
