Obama made an EO that wasn't to take place until 2021. His presidency ended after 2016. Joe could have reinstated the requirement on the same day he killed Keystone so his buddy Warren Buffet could continue to prosper hauling oil, by rail. Also, the EO was only for certain configurations of cars. There was also a speed requirement involved. If the trains only go 30mph through a town, they were exempt for the new brakes.
I have a great solution. Go into the cell and ask dude what he wants for a last meal. Have another guy come in and say the Governor has just given him a pardon and he was free to go home.
