Joe could have reinstated the requirement on the same day he killed Keystone so his buddy Warren Buffet could continue to prosper hauling oil, by rail. Also, the EO was only for certain configurations of cars. There was also a speed requirement involved. If the trains only go 30mph through a town, they were exempt for the new brakes.
