From my understanding: Since mitch says no recess appts, let us say the senate fails to set a date. Johnson can call for a date to recess the house. That would allow the president to step in and set a date to resolve the dispute. I'm certain the D would fight it. It appears to be in the constitution, but I don't think it has been used in that manner before. Not 100% on it though.

Had the AG not played a huge role in torpedoing his first administration, then trying to imprison and bankrupt him, I’d feel differently.
