But what makes them "new" ballots? Any ballot not counted yet is new unless they arrive at the count location now. Which/what is it? CA is known to have 1-2M uncounted ballots yet. The Senate has to be in recess. There doesn't have to be agreement with the House. Net, don't see what Johnson/House has to do with it.

The president adjourning Congress himself just to make recess appointments has never been done before. In fact, adjourning Congress under Article II, Section 3 has never been done before at all.
