Letcher Co shooting

After not being on the Paddock for months, I made the mistake of reading through this thread. What a bunch of easily swayed by rumor, ignorant, mouth breathers. No wonder Trump is the KY messiah.
Maybe try leaving for YEARS if you hated so much. I do not think ANYONE believes the rumors, just stated them. Great idea by you, just develop tunnel vision, it was a senseless murder, and call it a day. Nothing like the rumors tossed around have ever happened before. LOL. A lot more crazier shit has happened in this effed up world, it CAN be true, but as of now, only a "rumor".

Anyone know if there will be a livestream of the preliminary hearing?

Im curious too. Was told today the lawyer hired was bartley from out of town. I know him but hes in somerset and from what i know he never practiced in letcher.

Curious if that means there is already a decision on change of venue or its expected to have mostly zoom bearings because thats a healthy drive to letcher if that has to be made very many times.

Stating rumors is spreading rumors. About a man who was murdered.

And everyone's welcome to developing tunnel vision, because no one in this thread is in charge of solving this. There's much, much smarter people than your dumb ass whose job that is. They have access to witnesses and evidence instead of ”what I heard on duh Internet”. Just shut the f up

Yes, that's a long way from Letcher County. The preliminary hearing (in Morgan County, I think) is scheduled for today at 1:00 pm. Thought it would be waived but it hasn't yet been waived. Will be interesting to see if it takes place and what comes from it if it does.

Agree. I suspect the circumstances made it difficult to hire someone local although noone in letcher could really handle this.

Im torn on the waiving. I always used it as early discovery but I dont think you get any discovery value from one here whereas the prosecution gets to put out motive etc further tainting any potential jury pool you have.

Plus you start the clock running in the very unlikely event they cant convene a grand jury to indict in time. Even if that happens, its just a dismissal without prejudice. That will still get the defendant temporarily out of jail. Irrelevant because they arent letting that date slip

At the same time, that publicity will help you as the attorney and is presumably one reason you take this case for a presumably discounted rate. That publicity wont effect your client because everyone already knows this case and its going to be pretty impossible to seat a jury anywhere that didn't hear about it.

WTF are you to come on here and try to dictate what people can and can't post ? If only you was as smart as you think you are. No one is spreading rumors, I said IF. You know IF the rumors are true. IF< IF< IF< IF, meaning I am not saying it is fact. But this is a message board, not a court of law. GFY and try not to think too much of yourself. I guess message boards need to be by the book, no discussing or having an opinion on anything, it all has to be posted as is, after the fact so nobody won't post something that isn't 100%. Waiting until everything or anything is over and done before discussing, kind of takes message boards whole purpose away, no ?

Discussing something does not mean spreading rumors.
 
Looks like the prosecution alluded to the daughter being the motive but let the video be the vast majority of the evidence.

Hard to say if this is going to be the motive or not but sure sounds like his belief is going to be their focus. Very small amount of evidence put on by the Commonwealth was the wise move.

A couple important distinctions I'm still not sure about. First, was the daughter's phone number on Judge Mullins's phone already or was it on it because Sheriff Stines had called her from Judge Mullins' phone. That was unclear to me. Secondly, there's a person on X stating that the KSP detective testified that Sheriff Stines said Judge Mullins was going to kidnap his wife and daughter. I heard it differently and thought the KSP detective said Stines said "they" were going to kidnap his wife and daughter. Either way it sounds like a deranged mind but even more so about the "they" or "they're" part.

I don't see any reporting on that during the prelim. I do recall initially there being reporting that he said after the act "they took my wife and daughter from me".
 
The video of the shooting is up on KY Trial Court Review if you want to see it for some reason. I see no way to watch it other than that the sheriff made absolutely sure the judge was dead and repeatedly made sure he followed up with multiple headshots from different angles.

Without some incredible explanation, I don't know how this is anything other than a death penalty case.

Well that story actually begins to make a bit of sense.

And, FWIW, I have no interest in watching a man shot to death.

This makes the most sense and if true, he should be locked away and not treated fairly as he requested.

Makes sense. Seems to be no doubt he was suffering some mental disconnect. Disabled the office Facebook page and became distant and paranoid, apparently.

My assumption when there was the two phones was the sheriff had the daughter's. Just couldn't put together a reason the number would be in there other than the obvious.

Wont hear much more until indictment. Grand jury might ask for motive but that isn't open. Might take all the way until discovery or bills of particular.
 
I’m no expert on testimony or what exactly was expected from that Detective but he didn’t seem too up to speed on the investigation. I’m guessing he was being rather vague on purpose. He definitely wasn’t taking the bait on whether he thought there was some sort of mental disconnect after the sheriff got done with the phones before he shot. I also felt like he was acting a tad “ignorant” when it came to the phone record questions

Saw the video and that's not the actions of a good man. If I was his lawyer I'd be pleading insanity or other mental disorder.

I mean, he shot the judge once. And then as the judge was trying to get back up he put one right in his head execution style.

I'd be all in favor of frying this guy if it's proven he's of sound mind and body.

Yeah, I'm sure the investigation is still on going and anytime one government official kills another, the hush fest begins very quickly until trial.

One of my posts well before guessed edd would be a grand slam victory for defense but they could count as a win anything short of the death penalty. Thats why, even though i know jeremy, i think the right move was to let the dpa handle this one.

At the prelim, the prosecution goal is to get a finding of probable cause to have it bound over to the grand jury. Even if that doesn't happen, they can still directly submit it. So there really is no value at all for the prosecution in these hearings so they want to provide as little info as they can. Sounds like they did just that.

From a defense perspective, these arent hearings you can really win especially since they can still indict anyway. So you use them as an early discovery opportunity while the witnesses are under oath hoping you can use it for impeachment later at trial if someone says something different.

The Courier Journal story had a photo of unnamed "supporters" of the sheriff in the gallery yesterday that I would believe likely to be the sheriff's wife and daughter.

Anyone know if that is true?
 
Perspectives will be much different between two completely different types of people.

1) Those with children, and more specifically with a daughter
2) Those without children, or don't have a daughter

If you haven't watched your daughter walk into a mall at 12-13 with a couple of friends and been terrified, or watched her walk around a park at 7-8, or go sleep at a friends house who you know, but don't really know, then you have no clue what you are capable of in a moment where your worst nightmares may come true. Who knows if that's what caused it, but if it was because he had raped her (statutory and/or otherwise) then I can completely understand how it would happen. Don't agree with it necessarily, but I can definitely understand it.

Right after the shooting, he told police "they took my wife and daughter from me". Apparently it came out at the hearing, he told someone his family was being kidnapped.

I cant tell if the latter is just an interpretation of the actual quote or a separate statement made, but its bizarre altogether. For starters, who is "they"? And how did "they" take his family?

All in all, especially when coupled with the events preceding, it sounds like someone having mental health issues. Thats why i was surprised noone made a motion for a competency hearing, which was maybe made but just not public.

For the defense, assuming hes competent, it really doesn't matter what was actually going on. It just mattered at the time what he reasonably thought was going on. That will have to be the focus to set up the edd and 2nd degree instructions. If they lose on 1st degree, then it will be the defense only hope of mitigating circumstances.
 
Piecing things together, the Sheriff has mental problems and had a mental break. Killed an innocent man. My friends in the area basically indicated as much, but they don't necessarily know the truth either. I am fairly confident that if the defendant was not a sheriff, it would be a fairly open and shut case. I hope it's treated in the same way.

Not that I know the details of their interpersonal relationship, but this is my impression

Thanks. The report of what was told to the officers who took him into custody was he had one statement "they took ky wife and daughter".

So sounds like the ksp trooper is interpreting the original statement rather than a 2nd statement.

After watching that video, there’s no justification. That was an execution. He shot that man at least six to seven times with pauses in between. That was cold blooded murder. After the first shot, you can see the judge try to get up. And the sheriff just shoots him damn near point blank in the head once or twice. He then goes back around the desk moves the chair and shots him two more times after he’s clearly down. It’s the pauses that get me. Like had he just emptied his clip into him in one rage action i might see it. The pauses between shots are just soulless.
 
Watched the video of the preliminary hearing on Kentucky.com. When they play the shooting video on there of the courtroom, you can see Stines and the people behind him and not the video of the shooting. The people in the first row behind the defense table appear to probably be his daughter, his wife and another man. The daughter, turns away and doesn't watch when the prosecution plays the video of Stines shooting Judge Mullins. The woman who is likely Stines's wife appears to be looking down but starts to cry and the man next to her tries to comfort her. It's unclear if she sees the shooting or if she hears Judge Mullins' family crying. Stines, himself, looks down and appears to not want to watch it.

When the defense attorney asks the KSP detective about Stines calling his daughter from his own phone and Judge Mullins's phone there is little to know reaction from the daughter. The mother does put her arm around the daughter. Stines is still looking down much of the time.

One thing I caught when I watched it again is the KSP detective volunteers that the daughter has made statements about what had occurred, apparently with these phone calls. It's almost as if the witness wants to go there. While the defense attorney asks the detective for hearsay statements throughout, at one point even noted to the detective that he's allowed to testify regarding hearsay in a preliminary hearing, the defense attorney steers away from asking any questions about the daughter's statements. He, instead, pivots to whether Judge Mullins had apps on his phone. Who doesn't have apps on his or her phone nowadays?

I didn't watch but are you sure the question wasnt about "whatsapp"? Thats an app owned by Facebook thats commonly used as a clandestine way to text someone.
