SCOTUS also once ruled that separate was equal and murder was a choice protected by the US Constitution. I think we all agree those were bad decisions. IOW, bad decisions can be reversed.
I never thought that they'd rule against TikTok. How many times has a social media giant cried 1st amendment and won? If they are able to project this in the same vein as "protection of US citizens", coupled with the Laken Riley bill recently passed. I could see them go either way. It's going to be interesting to follow.

Would like to hear from the litigators how common it is not to have the parties file briefs on a motion in a case this important.
 
You hit on one of the big issues with the DEI focus.

When hiring starts to be based on things other than merit, you can’t tell who is competent.

I made that point recently with the LA wildfires. That fire chief actually seemed to have been at least semi competent as far as government officials go. But since LA and the FD were so heavily focused on DEI above all else, everyone just assumed she was an incompetent DEI hire. Not fair to her as a a human that the focus becomes her gender and sexual orientation.

She failed that bar so many times that it was given to her. She never really passed it. She was given it because she is stupid

You have eyes. The last several years have shown far too many examples of DEI incompetence, from Karen Bass to Kamala Harris to Claudine Gay to Lori Lightfoot to Fani Willis to the LAFD leadership. Promoted because of identity, period. It’s so bad that we pretty much now accept that certain roles are reserved for certain people based on which box they check.

And if you’re really curious, you need to understand that DEI is just one branch of a poisoned tree. The other branches are similar- in order to be promoted you must be ideologically pure. This applies to all races, male or female. It explains the collapse of the universities, of media, and of some businesses as they become ideological echo chambers. The poisonous tree is Marxism. And the people have rejected it all, correctly, because it’s antithetical to the principles of our republic.

Don't you understand that you're labeling minorities in positions of power a DEI hire? You're essentially saying anyone that's a minority in power is unqualified. It doesn't matter how many go to college, earn multiple degrees, have decades of experience, etc, you ignore that and use your bias to claim a minority is unqualified.

Say they were unqualified, there are still white people that are just as unqualified for a role. Why aren't they considered a DEI hire?

Kamala, while she was horrible choice, had decades of experience as a lawyer. She had to pass the bar herself, that's merit. She was elected to multiple positions, that's merit.

My brother, it is common knowledge that she and Willie Brown entered intoa relationship when he was Mayor... and still married. He made a junior position for her and her career went straight up from that lofty position.

Lloyd Austin was 100% a DEI hire in that the numero uno reason Biden hired him was because he wanted a minority in that role. I haven't really looked into Austin's record, he could very well have been the most qualified man for the job. But the absolute primary reason Biden hired him was because he was black. Same thing for the SC Justice Jackson. Biden flat out said he was looking for a black woman for that role.

That doesn't make any sense. You could be proud of your heritage regardless if DEI were real or not. DEI is relatively new, people have been proud of their heritage for as long as they've been around.
