A student is suing Ohio University, saying he was unfairly suspended for sending dozens of text messages to a female classmate, including some that made sexual overtures
Over several months starting in October, Marshall repeatedly sent text messages to a female classmate trying to spark a romantic relationship, according to the lawsuit. The two were in the same university honors program and had often exchanged text messages since 2013 about classes and their personal lives.Even after the woman twice said she wasn't interested and turned down an invitation to dinner, though, Marshall kept sending messages.The woman, who is not named in the lawsuit, told school officials about the messages and said Marshall once touched her shoulders at a party, making her uncomfortable, the lawsuit says.
A panel of university staff members concluded that Marshall broke the university's sexual-misconduct rules because he "made her feel uncomfortable and disrupted her ability to focus in the academic environment, due to their classroom requirements and future frequent interactions," according to the legal complaint.
