NC State is copying UNC in case vs NCAA

Did you guys see this? Sooner or later, the NCAA is going to realize they screwed that UNC case up badly. Because now, everyone they try to nail, is going to fight them.

Heck, NCST is even using the same law firms that UNC used.

When UNC escaped NCAA punishment despite decades of academic fraud, NC State fans, like a lot of other people, were disgusted. However, as we’ve seen since UNC’s case ended, a lot of schools have followed their model and simply contested everything.

Apparently testifying under oath and under penalty of perjury in a federal court isn’t proof enough.

And it should be noted that Smith has denied knowing Gassnola or knowing about any payments from Adidas.

NC State also argues that if any payments did happen, the money came from an agent, not from Adidas, so it wasn’t actually a recruiting violation but rather an impermissible benefit.
 
I can't decide which outcome I prefer:

1 -- Given NC State's hatred of UNC, I'd like to see the Wolfpack back the NCAA into a corner, get off without punishment and further make a joke of that inept institution, while rendering them even more disgustingly impotent than they already are.

OR

2 -- I'd also like to see the NCAA punish NC State, further igniting debate about the NCAA's appalling lack of adherence to any precedent, thereby setting off a media firestorm that eventually leads to their tasty demise.

Choice, choices.
 
The only problem is they wont have the same infractions committee. Just because that BS worked with Greg Sankey doesn't mean it will work with a person with common sense. People keep saying the NCAA like it's a 3rd party organization that rules on every case and uses precedent like courts do. For the 50th time, "the NCAA" is its member institutions and they have committees that rule on everything, committees that are made up from individuals from member institutions and committees that charge and have their own independent opinions.

Great post. It almost feels like a no-win situation for the NCAA. They threw UNC a bone, right in front of 350 other schools.

NCAA is definitely in a tough position. Should have just punished UNC accordingly.
 
Exactly. Deny, lawyer up, sue, counter sue, play ineligible players. Do whatever you gotta do. At this point, who gives a damn. NCAA will eventually back down if schools have enough money to fight..
Sad but true.
NCAA reminds me now of the Abominable Snow-monster from the old Christmas cartoon. A toothless monster that is all bark and no bite....as long as you have money, lawyer up and lie.

Just a FYI, Walter Harrison, former president at Hartford is overseeing the NC State case. He may or may not have the same philosophy that SEC commissioner Greg Sankey had when he inexplicably gave UNC a pass.

NCAA screwed up when they let UNC skate..... they set a precedent. Lawyer up and tell the NCAA to get bent..... the NCAA neutered itself... but then again, this is the NCAA. They can do whatever they want and let anyone they want get away with anything... they dont answer to anyone.

The NCAA has never had precedent. Yall keep setting yourself up for disappointment when you think this. Each infractions committee makes their own decisions.

They would be stupid not to do the same think that UNCHEAT did, hell just do like the Rat Faced Bastard at Dook does and refuse to talk , tell them you will investigate the situation yourself and and then tell the NCAAs there is nothing to see so run along .
 
This whole thing pisses me off. Integrity is dead and it sickens me. What’s the point of being honest anymore? Oh yeah. Because it’s right damn thing to do.

If you cheat, you should be punished. Period.
I’m kinda glad these people are trying to skate. Shows exactly who they are. I used to think most people were honest hard working individuals. How freaking naive I was. And people wonder why I have trust issues?

Can someone translate this? I can't find a copy of the response but apparently NC State brought up Bam's name to the NCAA.

 
The NCAA has to grow a backbone and start enforcing the rules or else you will have schools doing it the right way and the outlaw schools. It will never be a level playing field
 
The NCAA put everything on UNC it could, and UNC played out it's legal council with a rock solid case for federal court. The NCAA has argued time and again successfully to the lack of jurisdiction in individual suits for rigor of classwork, cannot and was not held liable. Successfully argued in depth to It being an accreditation issue, not the NCAA' s role. It was put up or shut up time for the NCAA, after years. Precedent is a key word, it was set on that issue in federal court. They had a sure loss case and had already spent 18 million trying to pressure UNC (UNC spent 22 million and was fully loaded to annihilate any sanctions in court at that point). Lesser monied schools would of had to take the punishment, couldn't afford the years and millions to fight it. Paying damages (like Penn State overreach)and having to payUNC on top of the added money the NCAA would have to spend to fight against their own statements in fed court, then after the almost certain fed court ruling explaining the years "damage" at that point was not realistic. They addressed the issue in winning class action cases on the issue in prior cases setting precedent. They were at the end of a losing road. It was shut up or do it, court time, shut up with the threats, penalize or drop. Had to hope UNC would say it's wrong and accept a punishment they had no legal grounds to issue.

NC State is not a class rigor case. They will have to argue no knowledge or connection to payments, and convince the NCAA they are the victims of fraud. Much different case and a losing one in fed court to argue, as it is clearly in the the NCAA's jurisdiction to penalize.

Too much money at stake not to cheat, especially if the NCAA won't go after certain schools. Tell 'em to pound sand and talk to our lawyerS. Ain't got a warrant? Get lost or I'll have you arrested for trespassing.

Yes. I don't understand how everyone forgets that the NCAA doesn't police academic fraud. UNCheat lied through their teeth and there was nothing the NCAA could do about it.

That did not work very well for them in the Penn State case. They were HAMMERED in the courts. They have by laws that they must follow. The "you don't like it quit, we make the rules up as we go along does not win in court.

If the case is a loser. The NC State issue is fully in their powers. That case I think they fight.

Money does play a major role though. The Wright State's of the world could not survive the years of NCAA applied pressure and millions to fight the case, like UNC or Memphis (FedEx) could. Even if they have a winning case, the little guys do not have the financial ability to fight it. Happens in the world daily. "We are going to do it anyway, if you don't like it sue us". Those who can afford the fight do just that, those that can't take it.

That's true, but in this case, the national perception may be just as important as the reality.
 
But he shouldn’t be eligible at all. Why did Wiseman get 13 games and Kanter get the whole season?
Because the committee that ruled on Kanters eligibility gave a harsher penalty for the $30k that they say Kanter got than the committee that ruled on Wiseman's eligibility for the $11k that they say that he got.
 
Huh? Wiseman got a 13 game suspension.
Big time suspension. He will be back soon and Memphis kept winning without him. He will play for most of the conference games and all the NCAA tournament games. Wow. What a penalty for receiving thousands in funds in violation of the NCAA rules.

Umm yeah, the Ohio State football players got 5 games for illegal benefits for memorabilia, Todd Gurley got a 4 game suspension for receiving $3k in illegal benefits and there are 100 other examples.
