Zeigler is seeking damages in excess of $25,000 against each defendant, as well as attorneys' fees and costs, for alleged defamation and false light, according to the lawsuit.


The lawsuit claims that Bendix, Burgardt and Foster each posted "false and defamatory statements" about Zeigler on the sports website CSNbbs.com while using the online pseudonyms "MajorHoople," "Chipdip2" and "DesertBronco," respectively.

Yer screen name ain't gonna protect you from talking ish about someone & they hire a lawyer

Hopefully Zeigler loses the case. Just silly and ignorant. It's message board talk, nobody should care that much unless somebody threatens harm others, or circulates something truly serious.
I hardly believe that Zeigler's "damaged reputation" in the forum world on that one site is worth $75,000.
 
yep this has happened before. This is crap but I guess you should always avoid defamation.
 
I dealt with this a few years ago as mod on a photog board
Cases are always thrown out
Nobody can prove who was behind the keyboard and jurisdiction is problematic as is proof of material injury
Further more the courts don't operate to adjudicate petty online social grievances
The plaintiffs lawyer is an asshat, ignorant of the area of law he is practicing
Should be disbarred

Actually, you can lock it up pretty well in tying posts and activity to a person. Although it's more sophisticated than the average person can delve into (including me). But there are companies that will do it for businesses or individuals, just have to be willing to pay for it. I do think it's silly for some things but there have been circumstances where there is internet stalking and basically trying to smear reputations with blatantly false claims. And in those instances, I believe it's totally ok to go after someone...also if it's costing someone money, etc...because of it. General message board chatter isn't really what I'm referring to as much as instances where entire websites get built, etc... and have false information on there. It's a bit of swatting flies and only worth the time and money if it is legitimately more than people just running their mouths some. While there isn't a lot of depth in these types of cases that have been handled because judges just haven't figured out how to deal with internet issues in many cases, there have been some that have been won by a claimant but they just need to be tied up pretty nicely with IP addresses, etc...to get the judge to recognize it easily.

I agree. And to expand that..if you hate cops, the next time you need a policeman in an emergency-
Dont call 911 cause your hate police will show up. Call your dealer. Maybe he will come to your rescue when somebody is trying to kill you.

911 for sure. i also like to stay in close contact with mr smith, mr wesson and mr mossberg.
 
Depends on what was said and what damage occurred but it's good advise not to make unproven negative statements about folks on boards. Even if the case if frivolous, you will still have to pay for an attorney and in this country you can't recover attorney costs if the case is dropped or you win.

If you have to weigh into a controversial topic use the word "alleged" liberally.
 
one would think that zipp would file a lawsuit against some of our posters. i mean they have named him as a person who defrauded elderly people and the city out of money and he nor anyone over there seems to worry about it.
